Some Dodge and Fiat Models Recalled Due to Bad Brake Fluids

January 18, 2012,

The National Highway Traffic Safety Administration has issued a recall for the 2012 Fiat 500 compact car and 2012 Dodge Journey midsize SUV. The assembly of certain models of these vehicles may have included contaminated brake fluid. The contamination of the brake fluid can lead to drivers' inability to stop the vehicle causing dangerous accidents. The contaminated hydraulic brake fluid is responsible for the deterioration of the vehicles' brake seals. 2012-Fiat-500-Right-Angle-View.jpg

According to the NHTSA and Consumer Reports, "if the seals fail and there is a loss of braking power, the risk of a collision increases". This increased risk of collision will occur in addition to the frighteningly high risk of collision which already exists on the road. As an experienced Orange County personal injury attorney, I have seen numerous cases in which a consumer product manufactured and issued by a reputable company ends up endangering the consumer. When a company produces a product and places it on the marketplace for open consumption, that company is responsible for ensuring that its product provides adequate safety to consumers and is free from hazards like these. And when a company's product is defective, like these Dodge and Fiat models, they are responsible for their defective products and the safety hazards as well.

What makes these safety hazards even more scary is that the FIAT 500 is a very compact car which means that it will have a very hard time surviving an accident of any magnitude. Although NHTSA, however, has named the FIAT 500 a "Top Safety Pick," without effective brakes, no amount of safety design and innovations will help those driving in the FIAT 500 from the serious injuries caused by car accidents.

Injuries sustained by the victims in these cases are often catastrophic and can result in death. Any accident will certainly result in a pile of medical bills that can be very daunting to the average American - especially in the face of losses of current and future wages.

If you, or someone you know, have been the victim of hazards associated with any consumer product, please do not hesitate to contact the Law Offices of Cohn & Swartzon.
